Section 1: Introduction

1.1 Purpose

The Judicial Procedures Guide provides the basic information every civilian is required to know regarding the Judicial System within Praxis Roleplay.

The Judicial System exists to ensure that all rights, whether substantive or procedural, are enforceable under the law. The court system provides fair and impartial hearings for both criminal and civil matters while ensuring all parties receive due process.


Section 2: Judicial Procedures

2.1 Arresting Procedures

When being arrested by Law Enforcement, the individual will be transported to a law enforcement facility for processing and charging.

Once County DOC assumes custody of the individual, that character may no longer be utilized for roleplay until the judicial process is completed.

Law Enforcement has five (5) days to submit all arrest documentation after custody is transferred.

If a character has been arrested and no contact has been made by a State Attorney within five days, the civilian should contact a member of Judicial Relations Administration.

Plea Options

Upon being charged, the defendant may enter one of the following pleas:

Guilty Plea

Results in conviction.

Character serves the assigned sentence.

Court proceedings are waived.

Not Guilty Plea

Results in the scheduling of a court hearing.

A judicial docket will be created.

The case proceeds through the court system.


2.2 Court Procedures

When a defendant enters a Not Guilty plea, a docket will be created and posted within the appropriate Judicial Relations channels.

The docket will include:

Case information

Involved parties

Assigned Justice

Court date and time

Relevant case documents

Legal Representation

It is the responsibility of the civilian to obtain legal representation.

If a civilian is unable to secure legal counsel, representation may be provided by the State of San Andreas upon request.

Court Appearance Requirements

All participants attending court are expected to:

Dress professionally

Maintain courtroom decorum

Follow instructions provided by the presiding Justice

Formal attire is mandatory for all standard court proceedings.

Traffic Court is exempt from formal attire requirements.

Confidentiality

Information contained within a judicial docket is considered In Character (IC) information and may not be shared outside the case.

Questions regarding a case should be directed to:

Assigned Legal Counsel

Presiding Justice


2.3 Summons Procedures

Certain offenses do not require immediate arrest.

Non-Violent Misdemeanors

Non-Violent Misdemeanors result in a Criminal Summons rather than immediate arrest.

Upon receiving a summons:

The defendant has thirty (30) days to appear.

Summons Court is held approximately 4–5 times each month.

Failure to appear within thirty days will result in:

A warrant being issued

Charges for the original offense

SA574.11 – Failure to Appear

Extension Requests

A Justice may grant:

Up to fifteen (15) additional days

Maximum appearance period of forty-five (45) days

Violent Misdemeanors

Violent Misdemeanors require immediate arrest and processing due to the threat posed to public safety.


Section 3: Courts

3.1 San Andreas Court System

The San Andreas Judicial System consists of three primary courts:

Supreme Court

The Supreme Court serves as the highest court within the State of San Andreas.

Location: Capitol Building

Responsibilities include:

Constitutional matters

Appeals

Major judicial rulings

Presided over by:

United States Attorney General

Justices of San Andreas


District Court

Location: Mission Row

Presided over by the Chief Justice.

Handles:

Major felony cases

Cases below Life Without Parole

Cases below Death Penalty eligibility


Circuit Court

Location: Mission Row

Presided over by Associate Justices.

Handles:

Misdemeanors

Low-grade felonies

General criminal proceedings


Section 4: Government Positions

4.1 Attorneys

Individuals wishing to become:

State Attorneys

Defense Attorneys

Must successfully pass the Praxis Roleplay Bar Examination prior to appointment.


4.2 Law Firms

To establish a State-Recognized Law Firm, applicants must meet the following requirements:

Eligibility Requirements

Must hold Civilian or Auxiliary Civilian status.

Must maintain an official website.

Must establish firm regulations and responsibilities.

Must maintain a complete employee roster.

Must maintain proper legal documentation.

Must possess an approved business property location.

Failure to maintain these requirements may result in recognition being revoked.


Section 5: Rules & Guidelines

The following rules apply to all members operating under Judicial Relations.

General Rules

All Praxis Roleplay Rules and Regulations apply at all times.

Corrupt roleplay is prohibited unless explicitly approved by the Head of Judicial Relations.

Every case must be documented by both the State and any involved Law Firm.

Law Firm owners are expected to maintain accurate documentation for all legal actions.

Professionalism must be maintained when representing clients.

Members must act respectfully and professionally toward all community members.

Legal professionals must work to protect the integrity of their firm and the Judicial System.

Law Firm Requirements

Firms must maintain direct communication with the Head of Judicial Relations.

Activity and compliance reviews may be conducted at any time.

New employees must be submitted to Judicial Relations for:

Vetting

Approval

Background review

Enforcement

Violation of any Judicial Relations policy may result in:

Suspension

Revocation of Bar Certification

Removal from Judicial Relations

  • Termination of Law Firm Recognition

The Head of Judicial Relations reserves the right to remove any member deemed unfit to serve within Judicial Relations.
